한편, 산림으로부터 100m이내의 불법 소각행위 적발 시 100만원 이하의 과태료를 부과하게 되고, 실수로 산불을 내더라도 3년 이하의 징역 또는 3,000만원 이하의 벌금형에 처해질 수 있다.
