법인은 기부할 수 없으며, 기부자는 10만원까지는 전액을, 10만원 초과 500만원 이하는 16.5% 세액공제 혜택을 받을 수 있고, 1인당 연간 500만원까지 기부가 가능하다. 지자체는 기부자에게 기부금 30% 이내에서 답례품을 제공한다.

하지만, 지방재정 확충과 지역 경제 활성화, 지역 주민 복리 증진 등을 위해 시행된 고향사랑기부제가 4일이 지났음에도 불구하고 참여가 매우 저조하다는 지적이다. 

1월 5일 기준 경기북부 지역 5곳의 고향사랑기부제 참여인원과 총 기부금액을 확인한 결과, 가평군 8명 90만원, 의정부시 8명 47만원, 양주시 5명 50만원, 동두천시 1명 10만원, 포천시 5명 500만원으로 참여 인원이 10명도 채 되지 않는다.
