개발제한구역 내 불법행위의 예방 및 단속에 관한 규정에 따라 개발제한구역의 불법행위를 단속하기 위하여 경기도에서 항공사진 촬영을 실시하고, 전년도 항공사진과 대비해 변경사항을 적출한다고 했다. 

그 이후, 각 시·군에서 판독시스템을 이용하여 현지조사와 결과보고를 수행한 뒤, 이를 통해 불법행위로 판정된 건에 대해서는 행정조치를 추진하게 된다고 했다.

2020년 항공사진 판독을 통해 불법으로 의심되는 건축물과 토지 형질변경은 총 569건이었고, 이 중 의정부시 개발제한구역 담당 공무원의 현장 방문 등 전수조사 결과 불법으로 적발된 것은 343건으로 60.3%나 차지하는 것으로 조사되었다고 전했다. 

불법 343건에 대한 분석 결과, 2019년에 항공사진으로 적발된 불법 57건에 대비하여 6배 이상 증가를 기록했으며, 유형별로는 건축물 신축이 289건(84.3%)으로 제일 큰 비중을 차지하였고, 뒤를 이어 토지 형질변경이 46건(13.4%), 증축이 8건(2.3%)이었다고 했다. 

불법 건축물 신축 289건에 대한 용도별 세부조사 결과는 창고로 사용하는 행위가 152건(52.6%)으로 가장 많았고, 이어서 근린생활시설(판매시설)로 사용하는 행위가 47건(16.3%), 주택이 39건(13.5%), 기타 51건이었다고 했다. 

불법 토지 형질변경 46건을 세부조사한 결과로는 주차장으로 사용하는 행위가 14건(30.4%), 임야를 무단으로 훼손하거나 임목 벌채하여 전으로 사용하는 행위가 13건(28.3%), 기타 19건으로 나타났다고 했다.

조사결과를 바탕으로 불법 창고·근린생활시설(판매시설)·주택으로 사용하는 행위와 주차장 확보를 위한 무단 토지 형질변경, 임목 벌채 및 개간 행위 등을 중점 단속대상으로 정해 관리할 방안이라고 했다. 

의정부시는 앞으로 항공사진으로 적발된 불법 343건에 대해 지속적인 현장 순찰과 사전통지 및 계고, 이행강제금 부과, 사법기관 고발, 행정대집행을 통해 행위자가 시정완료 할 수 있도록 강력하게 조치할 계획이라고 전했다.

이정석 도시과장은 “개발제한구역이 깨끗하게 보존되어 시민의 건전한 생활환경을 확보할 수 있도록 최선을 다하겠다.”고 말했다.
