관광휴양형 지구단위계획, 심의 없는 용도변경 “왜?”

 

지난 2월 가평군은 가평군 고시 제2022-37호를 공고했다. 고시는 관광휴양형 지구단위계획으로 가평세계평화박물관 조성사업 변경을 발표한 것이다. 변경 결정은 관광휴양시설용지 중 세계평화박물관의 녹지시설 중 조성녹지를 42,127㎡에서 35,975㎡로, 원형보존녹지를 기존 25,714㎡에서 22,067㎡로 감소하는 내용을 담고 있었다. 또한, 보전녹지를 1,592㎡ 신규 조성하는 안이 포함됐다. 

 

이외에도 변경안 가장 마지막 부분에 ‘기타사항에 관한 계획’이 포함됐다. 특혜시비가 일고 있는 부분이다. 가평군은 고시 내용 중 라항 ‘기타사항에 관한 계획’에서 경미한 변경사항이라는 내용으로 건축물 허용 용도의 변경안을 끼워 넣었다. 

 

‘국토의 계획 및 이용에 관한 법률 제 28조에 따른 주민의견청취 및 제30조에 따른 행정기관의 장과의 협의, 공동위원회 심의를 거치지 않고 지구단위계획을 변경할 수 있음’이라는 조항을 새롭게 작성해 넣은 것이다. 

 

이는 통일교가 박물관을 건설하는 과정에서 용도변경을 추진할 경우, 군의회와 군계획심의를 거치지 않고 손쉽게 변경할 수 있는 조항이다. 

 

가평군 관계자는 이와 같은 조항을 추가한 이유에 대해 “사업주의 편의성을 위해서”라고 설명했다. 

 

그는 또 “이전 조종면 밀리터리사업에서 이와 같은 경우가 있었다. 사소한 용도변경을 하려고 해도 심의를 거쳐야 하기 때문에 짧게는 한 달에서 길게는 수개월씩 사업이 지연된다”며 변경안이 추가된 이유에 대해 해명했다.

 

본지는 가평군이 지난 2019년 결정한 밀리터리조성사업에 대한 고시(가평군고시 제2019-321호)를 살펴봤다. 가평군 관계자의 말과 같이 밀리터리조성사업에서도 지구단위변경안이 추가돼 있었다. 

 

그러나 가평군 관계자는 밀리터리 사업은 가평군이 시행을 하고 있는 경우이고, 통일교 박물관은 민간이 추진하는 경우라서 같이 볼 수 없는 것 아니냐는 본지의 물음에는 명확한 답변을 하지 못했다. 가평군이 민간 사업자에게 용도변경을 용이하게 할 수 있는 조항을 넣은 것은 이번이 처음이다. 

 

기자는 가평군 관계자에게 이와 같은 용도변경 조항을 다른 사업에도 적용이 가능하냐고 문의했다. 군 관계자는 “같은 유형의 사업이라면 적극 검토하겠다”라고 말했다. 

 

또 “이번 사업도 통일교 측에 먼저 내용을 명시할 수 있도록 먼저 권유했다. 일종의 적극적 행정이다”라는 말도 덧붙였다.

 

가평군 관계자는 이처럼 용도변경이 손쉽게 이뤄질 수 있는 문항 추가를 먼저 제안한 것은 특혜가 아니라 적극 행정이라고 주장했다. 

 

하지만 가평군이 적극 행정을 이유로 공사 과정에서 언제든지 용도를 손쉽게 변경하게 만들어 준 것은 통일교 측에 특혜를 주었다는 빌미를 제공한 원인으로 작용됐다.

박물관이라 허가받고 천지선학원 공사?

 

현재 가평군 설악면 송산리 일대에서는 ‘가평세계평화박물관 조성사업’이 ‘천지선학원 신축공사’라는 명칭으로 변경돼 공사가 한창 진행 중이다. 해당 사업에 대한 공고는 지난 2016년 8월 발표됐다. 

 

가평군은 지구단위계획 지정에 대한 이유로 “수려한 경관과 자연 자원을 보유한 가평군의 관광객 유치 및 지역경제 활성화를 위해 관광휴양시설로 개발하고자한다”는 취지를 내세웠다. 

 

그러나 현재 공사가 진행되고 있는 ‘가평세계평화박물관 조성사업’은 1층에 박물관, 2층은 로비로 이용될 예정이고, 3층 집무실, 그리고 4층은 VIP공간이다. 

 

통일교 관련 사이트 및 유튜브 영상에서는 천지선학원에 고 문선명 전 총재와 한학자 총재의 사진 및 업적들을 전시할 예정이라고 밝히고 있다. 특히 양쪽 벽면에는 참부모님으로 표현되는 문선명 전 총재와 한학자 현 총재의 업적이 각각 7점씩 14점이 전시될 예정이다. 또, 13개관으로 구성된 2,000여 평의 전시관에는 참부모님의 성탄과 업적들을 전시할 예정이다. 

 

천지선학원은 통일교 창시자인 문선명 전 총재와 한학자 현 총재의 업적을 전시하는 곳으로 사용된다. 

 

취재 과정에서 본지와 만난 지역 관계자는 “가평군에서 통일교가 할 수 없는 일은 보지 못했다. 해당 부지에 불법적인 부분도 상당하다는 소문이 나온다”며 “이는 가평군이 묵인해 주지 않으면 할 수 없는 것이다”라고 이야기했다. 또 “가평군의 심의 없이 용도를 변경할 수 있는 길을 열어 준 것은 특혜로 볼 수 있다”며 자신도 이와 같은 편법을 통해 사업을 진행해야겠다고 말했다. 

 

한편, 본지와 통화한 통일교 관계자는 “변경을 하든 어떻게 되든 간에 법적 절차에 따라 진행을 하고 있다”는 과민한 반응을 보이며 짧은 답변만 내놓았다.
