[김일웅 기자= 경기북부/강원] 가평군 설악면 가일리 유명산 고개에는 30년 넘게 자리 잡고 있는 불법 포장마차가 가평군을 조롱하듯 버젓이 장사를 하고 있다. 가평군은 현재도 아무런 조치를 하지 않고 시간만 끌고 있는 이유가 무엇인지 본지가 취재에 나섰다. 지난 20년 12월 민원 발생으로 인한 가평군이 합동 단속을 한다며 ‘산림과,건축과,건설과도로팀,허가민원과식품위생팀’이 현장을 단속했다. 하지만 이후, 그 어떠한 행정 조치도 하지 않아 논란이 빚어지고 있다.

가평군이 무엇 때문에 불법포장마차를 행정처리 하지 않는지 들여다보니 어처구니없는 행동들을 하고 있었다. 이곳은 행정구역상 지목은 임야로 되어있고 또, 도로 접도 구역에 있으며 건축물을 지을 수 없는 구역이다. 가장 큰 것은 해당 토지가 가평군소유가 아닌 캠코(기획재정부) 소유로 되어 있어 복잡한 구조를 갖추고 있기 때문에 행정처리 주관 부서를 서로 밀고 있었던 것이다.

토지의 소유가 캠코(기획재정부)라고 할지라도 행정 위반 사항은 가평군에서 담당하는 것인데도 불구하고 서로 핑퐁을 하느라 제대로 된 행정 처리를 하지 않는 것으로 드러났다.

가평군 산림과에서는 지난 2021년 2월 초경 “2021년 5월 31일까지 자진철거”를 하도록 공문을 해당 불법포장마차 업자들에게 보냈다. 이날까지 자진철거를 하지 않을 시에는 ‘강제철거’를 하겠다는 내용도 포함되어 있는 것으로 확인됐다.

하지만, 불법 포장마차 업자들은 이를 비웃듯 그어떤 철거도 하지 않고 지금까지 불법영업을 계속하고 있다. 가평군은 불법 포장마차 업자들에게 강제철거를 한다는 공문을 보냈음에도 불구하고 강제철거를 하지 않은 이유에 대해서 “좀 봐달라고 해서 봐주고 있다”는 대답을 했다.

그렇게 봐주기 시작한지 30년이 흘렀다는 것이다. 이토록 단 한푼의 세금도 내지 않고 불법으로 현금만 받으면서 장사를 하게 하는 가평군의 안일한 행정이 정당한 세금을 내고 장사하는 상인들을 울리고 있다.

가뜩이나 코로나 19로 인해 고통을 받았던 정상적인 상인들에게는 법적인 잣대를 정확히 들이대면서 불법영업을 하는 업자들에게는 관대한 가평군의 행정이 올바른 행정인지 묻고 싶다.

가평군은 서로주관 부서가 아니라는 입장만 내세우며 핑퐁을 할 때 불법포장마차 업자들은 공유일 날 유유히 나와 현금 다발을 챙겨가고 있다.
