【양주브레이크뉴스 팩트체크】 대한행정사회 부회장 김완영 [기고] = 경기도 양주시의회는 개원 후 처음으로 2023. 8. 26.(토) ~ 9. 3.(일) [7박 9일] 헝가리, 오스트리아, 체코에 대한 해외연수 계획을 잡았다. 연수 인원은 총 20명으로 시의원 8명, 공무원 12명이 함께 연수를 갔다. 이중 정치인은 국민의힘 시의원은 4명, 민주당 시의원은 4명 동수이다.
그래서, 양주시의회는 하루도 조용할 날이 없이 정파 간 대립 속에서 양주시장은 늘 의회 문턱을 넘기가 쉽지 않는 구조 속에서 의원들과의 소통을 매우 중요시한다.
문제는 시민도 아닌 여야 시의원 모두에게 1인당 100불을 주었다는 것이다. 강 시장은 의원들과의 스킨십을 하기 위해 공식적 루트를 통해 관행적인 행동을 했다.
그렇지 않다면 조용히 만나 뒷주머니에 쓸 만큼의 돈 봉투를 주었을 것이다. 그런데 소액, 여야 모두 공평하게 공식적인 행동을 했다.
사실은 이렇다. 출발 이틀 전인 지난 8월 24일 강 시장은 S 비서를 통해 청사 1층 농협에서 900불(약 1백만 원)을 환전했다고 한다.
환전한 달러를 의회 사무과 A 팀장인 공식 루트를 통해 여야 시의원에게 전달 민주당 4명(400불)과 국민의힘 3명(300불), 당시 윤창철 의장 100불은 전달하지 못했다고 한다.
민주당은 익일 공식 루트(의회 사무과 A 팀장)를 통해 반납했고, 그 반납 금액을 시장에게 전달하려 했으나, 강 시장은 “팀장에게 100불과 반납분 400불은 공통경비로 필요할 때 사용해라”며 건넸다는 것이다.
사실 강 시장은 평생 공직자 출신이다. 그도 “현역 시절 때에는 의원들이나 상급자와 해외 출장을 많이 다녀왔을 것이다. 그래서, 수행하는 직원들의 보이지 않는 지출에 대한 아픔을 알고 있던 터라 팀장에게 공통 경비로 주었다“라는 후문이다.
이런 행동은 시장으로서 부하 직원에게 넉넉한 행동일 수는 있다. 다만, 현행 공직선거법은 엄격하기 때문에 문제가 된 것이다.
국민의힘 시의원들도 출발 당일인 26일에 300불 모두 반납하면서 해외 연수를 떠나는 해프닝이 벌어졌던 사건이다.
그런데 민주당 경기도당에서는 12일 논평을 내고 ”강수현 시장을 공직선거법 제113조 제1항 위반 혐의로 의정부지검에 고발장을 제출했다"라고 한다.
모 언론사의 기사에 의하면 “민주·법치주의를 부정하고 대한민국의 근간을 뿌리째 흔드는 행태를 결코 좌시하지 않을 것”이라고 보도했다.
과연 강수현 시장이 돈으로 선거를 유리하게 할 목적이 있었는가(?)에는 의문점이 든다. 그런 목적이었다면, 조용히 뒤에서 돈을 주지 공식적인 루트인 공직자를 통해 적은 소액을 주었을 리가 만무하기 때문이다.
필자는 이렇게 생각한다. 결론을 말하자면 관행적 행동이었다.
현 양주시의회는 여야 시의원 4:4 라는 어려운 구도 속에서 시장으로 모처럼 해외 연수를 나가는 의원들에게 작은 소통을 하고자 고민한 흔적에 불과하다는 것이다.
시의원들의 해외 연수에 대한 격려 방법을 다르게 했더라면 좋았을 것이다. 그냥 음식점에서 공식적인 예산으로 “여비를 드리고 싶은데 아시다시피 공직선거법이 있어서 죄송하다”라고 했다면 문제가 없었을 것이다.
개인 돈을 사용하면서 지금 곤욕을 치르고 있는 것이다.
이것이 강 시장의 약점이긴 하다. 아직도 정무적 감각과 참모들이 없기에 작은 실수로 큰 대가를 치르고 있는 것이다. 주변에서 “이제는 행정가에서 탈피해 정치가가 돼야 한다“라는 충고를 다시금 새겨 들어야 한다.
즉, 이는 소액인 관행적, 상징적, 공개적으로 여야 모두 공평성과 형평성 있게 집행했다는 점, 다른 의도가 없었다는 점 등을 종합적으로 비추어 볼 때 ‘비 양심적인 범법 행위’라고 까지는 아닌 듯싶다.
필자는 아래와 같은 몇 가지의 사유로 인해 문제가 없다고 본다.
▲ 시장이 시의원을 몰래 은밀히 만났거나 직접 전달하는 등 불손한 의도를 갖고 접근하지 않았고, 공식 루트 통해 공개적으로 진행했다.
▲ 어떠한 지지 행위나 의도도 없었고, 기존 행사의 일부 소액의 관행처럼 진행됐다.
▲ 시의원에 대한 격려금은 모두 연수 출발 전에 회수됐다.
▲ 지난 사전선거운동 벌금 80만 원과 이번에 고발된 공직선거법은 분리해 법원이 심리한다는 의견이 전문가들의 의견이다.
▲ 이 사건이 선거기간이 임박하거나, 불특정 다수의 시민이 아닌 시정의 협조를 구해야 할 시의원에게 공식적으로 전달했다. <이상>
